The rules of the road

The short version: Use Safilist to verify emails you have a lawful basis to process. Don't use it for spam, fraud, or anything illegal. We provide the service as-is, without guarantees. Cancel anytime.

1. Agreement

These Terms of Service ("Terms") govern your use of Safilist, an email verification service operated by Safilist Email Services, a business registered in Kenya, with a registered address at P.O. Box 10911-00200 City Square, Nairobi ("Safilist," "we," "us," or "our").

By creating an account or using the service, you agree to these Terms. If you do not agree, do not use the service.

2. About the service

Safilist is a software service that checks whether email addresses are deliverable. You upload a list of email addresses, we perform verification checks, and we return results showing which addresses are Safe, Risky, or Invalid — along with additional analysis on our Intelligence tier.

Verification is a best-effort process. No email verification service, including ours, can guarantee 100% accuracy. Certain domains (particularly catch-all servers) accept mail for any address, making it impossible to determine deliverability for individual mailboxes with certainty. See Section 7 for our warranties disclaimer.

3. Your account

You must provide accurate information when creating an account. You are responsible for keeping your password secure and for all activity that occurs under your account.

Notify us immediately at info@safilist.com if you suspect unauthorised access to your account.

You must be at least 18 years old to use Safilist.

4. Acceptable use

You may not use Safilist to:

Send, facilitate, or verify emails for the purpose of spam or unsolicited bulk messaging
Send phishing, fraudulent, deceptive, or misleading emails
Harass, threaten, or harm any person or entity
Verify email addresses you do not have a lawful basis to process under applicable data protection law
Attempt to circumvent rate limits, tier restrictions, or credit allocations
Reverse-engineer, scrape, probe, or interfere with the service, its infrastructure, or other users' data
Resell, sublicense, or redistribute the service or verification results without our written permission
Break any law that applies to you or your data subjects

You must comply with all laws that apply to you — including but not limited to the Kenya Data Protection Act 2019, the EU General Data Protection Regulation (GDPR), the US CAN-SPAM Act, and equivalent laws in your jurisdiction and the jurisdictions of the people whose data you upload.

Violation of these rules may result in immediate account termination without refund.

5. Your content

When you upload an email list to Safilist, that list remains your content. We do not claim ownership. We process it solely to run the verification you requested, and we delete it automatically 7 days after verification (see our Privacy Policy).

By uploading a list, you warrant that:

You collected the email addresses lawfully and have a valid basis under applicable data protection law to process them
You have the right to submit them to a verification service
You are the data controller for that list; Safilist acts as your data processor for these emails

You are solely responsible for the lawfulness of the data you upload. If you cannot warrant these things, do not upload the list.

6. Service availability

We work to keep Safilist available and running smoothly, but we do not guarantee uninterrupted service. We may need to take the service offline for maintenance, upgrades, or unforeseen technical issues. When possible, we will give advance notice.

We may modify, suspend, or discontinue features of the service at any time. If we discontinue the service entirely, we will give you reasonable notice and, where practical, the ability to export your data.

7. No warranty

The service is provided "as is" and "as available", without warranty of any kind, express or implied. To the fullest extent permitted by law, we disclaim all warranties, including warranties of merchantability, fitness for a particular purpose, non-infringement, and accuracy of verification results.

In particular, we do not warrant that:

Verification results will be 100% accurate
An address marked Safe will actually receive your mail
An address marked Risky or Invalid is unreachable
The service will be uninterrupted or error-free

You are responsible for how you use the results, including any business decisions you make based on them.

8. Limitation of liability

To the fullest extent permitted by law, Safilist will not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the service — including lost profits, lost data, damage to reputation, or bounced email campaigns.

Our total liability for any claim arising out of or relating to these Terms or the service shall not exceed the total fees you have paid us in the 12 months preceding the event giving rise to the claim, or USD 100, whichever is greater.

9. Fees and payment

Safilist offers a free tier and, when available, paid subscriptions and credit packs. Pricing is published at safilist.com/pricing and may change over time. We will notify registered users of material price changes before they take effect.

9.1 No refunds

All fees are non-refundable. If you no longer want to use Safilist, you can cancel your subscription at any time. Cancellation stops future charges but does not refund fees already paid.

Unused credits from pay-as-you-go packs remain available in your account until they are used or your account is closed.

9.2 Taxes

Prices are exclusive of applicable taxes unless stated otherwise. You are responsible for any taxes imposed by your jurisdiction.

10. Termination

You may cancel your account at any time from your account settings. When you cancel, we retain your account data as described in our Privacy Policy.

We may suspend or terminate your account, with or without notice, if you violate these Terms or if your use poses a risk to the service, other users, or third parties. On termination, all rights granted to you under these Terms end immediately.

11. Changes to these Terms

We may update these Terms from time to time. When we make material changes, we will notify registered users by email and post a notice on the site. The effective date at the top of these Terms will always show the most recent revision. Your continued use of the service after changes take effect constitutes acceptance of the updated Terms.

12. Governing law and disputes

These Terms are governed by the laws of the Republic of Kenya, without regard to conflict of laws principles.

Any dispute arising out of or relating to these Terms or the service shall be resolved in the courts of Kenya, and you consent to the exclusive jurisdiction of those courts.

13. General provisions

If any provision of these Terms is found to be unenforceable, the remaining provisions remain in full effect. Our failure to enforce any right or provision does not constitute a waiver of that right or provision.

These Terms, together with our Privacy Policy, constitute the entire agreement between you and Safilist regarding the service.
